EXECUTIVE SUMMARY
The Cannabis Tax Fund Grant Program (CTFGP) is an initiative administered by the California Highway Patrol (CHP) that distributes tax revenues from legal adult-use cannabis sales to local jurisdictions to provide financial assistance for the education, prevention, and enforcement of laws related to impaired driving.
After submitting a grant application, the Police Department was awarded grant funds in the amount of $63,627.20. The funds will pay for overtime costs associated with special Department operations for driving under the influence enforcement and impaired driving education. Funds will be paid to the City on a reimbursement basis. No City matching funds are required.
BACKGROUND
The CTFGP was established in 2016 under Proposition 64, the Adult Use of Marijuana Act, which legalized recreational cannabis for adults 21 and older. The regulations implemented a 15% excise tax on retail sales, from which the State of California directed a portion of the revenue to create the CTFGP and fund local law enforcement programs aimed at combatting impaired driving. The intent of the program is to educate the public regarding the dangers of impaired driving and to enforce impaired driving laws on roadways. Programs may include driving under the influence (DUI) saturation patrols, roadside checkpoints, and public education campaigns.
The Police Department will utilize the awarded funds to cover overtime personnel costs for directed DUI Saturation Patrols and impaired driving education and outreach. Funds will be paid on a reimbursement basis following submittal of quarterly grant claims.
Staff recommends approval of the Grant Agreement and two Resolutions. The Grant Agreement is required to be included as an exhibit to the Resolution accepting the grant funding per CTFGP guidelines, but is also attached as a standalone item for reference.
COORDINATION
The Grant Agreement and resolutions have been reviewed and approved as to form by the City Attorney’s Office. Grant claims and reimbursements will be coordinated with the Financial Services Department.
FISCAL IMPACT
The total grant award is $63,627.30 and will fully fund the cost of overtime for sworn personnel to conduct directed enforcement operations. City matching funds are not required.
