EXECUTIVE SUMMARY
On October 3, 2023, the City Council approved plans and specifications for the Manhattan Beach Boulevard Resurfacing - Aviation Boulevard to Inglewood Avenue Project, Job No. 41160 (MBB Project), authorized competitive bidding, and appropriated additional STPL funds. Due to a Federal Corrective Action imposed on Los Angeles County in the Fall of 2023, distribution of STPL funds by the Los Angeles County Metropolitan Transportation Authority (Metro) have been put on hold, effectively ending the STPL program. In April 2025, the Metro Board of Directors authorized STPL Fulfillment agreements to supersede STPL Exchange Agreements and allow the funds to be used on projects that begin on or after April 24, 2025.
Accordingly, staff is requesting a retroactive 2024-2025 budget modification resolution to appropriate $1,747,973 of STPL monies initially allocated to the MBB Project to the Aviation Boulevard Resurfacing - Artesia Boulevard to Manhattan Beach Boulevard Project, Job No. 41440 and a transfer of $1.1 million of Prop C funds from the Aviation Boulevard Resurfacing - Artesia Boulevard to Manhattan Beach Boulevard Project, Job No. 41440 to the MBB Project. This transfer would increase the total funding available for the Aviation Resurfacing Project (which is currently being designed by the City of Manhattan Beach and will be constructed after the new STPL eligibility date) and provide immediately available Prop C funds for the close out of the MBB Project.
The MBB Project is now ready to be formally accepted as complete by the City. If approved, staff will close out the Project, a process that includes payment of the final invoice, recordation of the Notice of Completion with the County, and release of the retention payment after the 35-day waiting period assuming no claims exist.
BACKGROUND
The MBB Project included asphalt resurfacing, striping modifications, traffic signal modifications at the intersection of Manhattan Beach Boulevard and Dow Avenue, landscaping and irrigation design for the existing raised center medians and frontage road median, installation of drywells, and installation of Class II bike lanes along the entire Project corridor.
On October 3, 2023, City Council approved plans and specifications for the Project, authorized competitive bidding, and appropriated additional STPL funds. On November 16, 2023, six bids for the Project were received and publicly opened. After review, Toro Enterprises, Inc.’s bid of $4,162,813.75 was found to be the lowest responsible submission. On December 5, 2023, the City awarded a public works contract to Toro Enterprises, Inc.
During construction, staff issued six change orders for a total of $268,936.71, bringing the final agreement to $4,431,750.46, a 6.5% increase over the original contract amount. The change orders allowed for landscaping revisions, bike lane, signing and striping modifications, installation of flashing yellow arrow left turns at Dow Avenue, new pedestrian push buttons, and additional concrete work quantities.
In April 2025, the Metro Board of Directors authorized STPL Fulfillment agreements to supersede STPL Exchange Agreements and allows funds to be used on projects that begin on or after April 24, 2025. Accordingly, staff is requesting a retroactive FY 2024-25 budget modification resolution to appropriate $1,747,973 STPL from the Project to the Aviation Boulevard Resurfacing - Artesia Boulevard to Manhattan Beach Boulevard Project, Job No. 41440 and $1.1 million from the Aviation Boulevard Resurfacing - Artesia Boulevard to Manhattan Beach Boulevard Project, Job No. 41440 back to the Project for close out. Metro estimates the draft STPL Fulfillment Agreement will be ready for the City’s review and approval by September 2025. Staff will present the Agreement for Council’s consideration of approval at that time to appropriate the full $1,747,973 to the Aviation Boulevard Resurfacing Project. Through this modification, the City does not incur the 2% administrative fee Metro typically charged through their previous and now obsolete STPL Exchange Agreement.
The Project is now complete and ready for City Council acceptance.
COORDINATION
This Project has been fully coordinated with the Public Works Engineering and Maintenance Divisions.
FISCAL IMPACT
Funding for the Project includes Measure M funds, Prop C funds, State Gas Tax, and Green Street Improvement funds.
