EXECUTIVE SUMMARY
For over two decades, the King Harbor Ocean Enhancement Foundation, managed by John Whitaker and Rich Ford, operated a white seabass grow-out facility with the intent to restore depleted seabass populations in the Pacific Ocean to a higher and more sustainable level. To replace the lost amenity, after the organization ceased operations in June 2019, the Waterfront and Economic Development Department negotiated an agreement with Coast Construction Group for the design and construction of a new seabass grow-out facility to be located off of Mole B, adjacent to the Harbor Patrol docks. On October 1, 2024, the City Council approved a contract with Coast Construction Group for the design and construction of the grow-out facility for a total not to exceed cost of $67,000.
The proposed amendment to the contract would increase the amount by $4,500, to accommodate current prevailing wage rates, and extend the contract term by four weeks, to August 1, 2025. Funding for the amendment is available in the Waterfront and Economic Development Department’s annual operating budget.
BACKGROUND
On October 1, 2024, a contract with Coast Construction Group, in an amount not to exceed $67,000 and a term through July 1, 2025, was approved by the City Council to execute the project. The proposed first amendment to the Agreement would add an additional $4,500 to the contract’s not to exceed amount for a new total of $71,500.
The increase to the not to exceed amount would account for the updated prevailing wage rates required by the Department of Industrial Relations, which were not included in the original Agreement. The extension of the contract term provides additional time for plan check/permit review by the City and Coastal Commission prior to construction.
Staff recommends approval of the proposed amendment to allow the contractor to continue services with the appropriate prevailing wage rates.
COORDINATION
The amendment was reviewed and approved as to form by the City Attorney’s Office.
FISCAL IMPACT
Funding for the proposed contract amendment is available in the Tidelands Fund portion of the Waterfront and Economic Development Department’s annual operating budget.
