EXECUTIVE SUMMARY
The Fulton Playfield Multi-Benefit Infiltration Project (Fulton Project) is included in the updated addendum, and the City Council approved Enhanced Watershed Management Program (EWMP) as a priority project. On November 21, 2022, the Los Angeles County Flood Control District (LACFCD) Board approved the FY 2022-23 Stormwater Investment Plan that included funding for the Fulton Project. The Transfer Agreement was completed on May 18, 2023, which secured grant funding of $93,000 for the City of Redondo Beach for FY 2022-223. Addendum No.1 to the transfer Agreement was completed on September 3, 2024 which secured grant funding of $2,073,000 for FY 2023-2024. Approval of Addendum No. 2 to the Transfer Agreement is needed to secure $1,683,000 of additional funding for 2024 and 2025, which will allow the City to move forward with Project implementation.
BACKGROUND
The City of Redondo Beach, in collaboration with the Cities of Hermosa Beach, Manhattan Beach, and Torrance, along with the LACFCD formed the Beach Cities Watershed Management Group to develop an EWMP to comply with the municipal separate storm sewer system (MS4) permit requirements. The City Council approved the first EWMP on June 16, 2015 and approved the updated EWMP on June 8, 2021. The updated EWMP includes the Fulton Project as a priority project for reducing the potential for pollutants being discharged into the Santa Monica Bay.
Fulton Field is an open green space and playfield at the southeast corner of the intersection of Ripley Avenue and Rindge Lane. The playfield is adjacent to an 8.5-foot by 10-foot LACFCD storm drain that runs under Ripley Avenue and connects directly to the Herondo Storm Drain on 190th St, which drains to the Santa Monica Bay. An underground flood control retention basin underlies the western half of the playfield and provides approximately 6.4 acre-feet of passive storage to help relieve flooding during storm events. Drainage from approximately 440 acres in the City of Redondo Beach and 25 acres in the City of Manhattan Beach is tributary to the basin. The Fulton Project proposes to add infiltration elements to the existing flood control basin in order to transform it into a regional water quality improvement project while maintaining its flood control capacity and function. Infiltration will be accomplished via the addition of drywells under the eastern portion of the playfield.
Pursuant to the Los Angeles SCW Program Ordinance and the SCW Program Implementation Ordinance, the Fulton Project was selected by the South Santa Monica Bay Watershed Steering Committee to be awarded $4,292,138 from the competitive SCW (Measure W) Regional Funding Program. On November 21, 2022, the LACFCD Board approved the FY 2022-2023 Stormwater Investment Plan that included the recommended funding for the Fulton Project. The Transfer Agreement was approved by LACFCD Board on May 18, 2023 and the City received grant funding of $93,000 for FY 2022-2023 and $2,073,000 for FY 2023-2024.
Addendum No. 2 was submitted to the City Attorney’s Office for review. During the review, Clauses B-13, B-19, and C-3 in the Exhibit-B and Exhibit C of the original Transfer Agreement were identified as differing from the City’s standard provisions and indemnification language. However, since City Council already approved those clauses for this Agreement and because LACFCD mandates the use of its standard language (rather than the City’s) as a prerequisite for receiving the $1,683,000 in grant funds for FY 2024-2025, staff recommends approval of the attached Addendum No. 2 as written.
COORDINATION
This project has been coordinated between the Public Works Operations and Engineering Divisions and the Beach Cities Watershed Management Group. The City Attorney’s Office has reviewed and provided comments on language for the Addendum No. 2 to the Transfer Agreement, as noted above.
FISCAL IMPACT
Approval of Addendum No. 2 to the Transfer Agreement will provide the next tranche of funding support in the amount of $1,683,000 to the Fulton Project. Failure to approve Addendum No. 2 to the Transfer Agreement would require the City to identify other funding sources in this amount to meet compliance requirements of the City’s EWMP commitment. The total funding award for this project is $4.3M.
