EXECUTIVE SUMMARY

The Rail Crossing Bridge on Artesia Boulevard, located between Condon Avenue and Firmona Avenue, requires painting to address deterioration and visual blight.  The City is authorized to perform this work under a License Agreement with the Los Angeles County Metropolitan Transportation Authority (Metro), who owns the bridge. 

 

Staff issued a limited Request for Proposal to identify the contractor and selected Signature Painting Inc. based on price, qualifications, relevant experience, and references.  The proposed Agreement provides for surface preparation, lead paint containment and removal, coating application, traffic control, and related work.  The authorized contract amount is $192,150, with a not-to-exceed amount of $225,000, including $32,850 in staff directed contingency for unforeseen conditions.  The work is anticipated to begin promptly after notice to proceed is given and be completed by the end of the calendar year.

 

Staff recommends adoption of the attached Resolution declaring the work as maintenance and approval of the agreement with Signature Painting Inc.  Funding for the agreement is available in the Capital Improvement Program through the Artesia Rail Crossing Bridge Painting project account. 

 

BACKGROUND

The Metro Rail Crossing Bridge on Artesia Boulevard straddles the City’s boundary with the City of Lawndale.  The City maintains a License Agreement with Metro authorizing the City to prepare and paint the exterior of the rail bridge.  The existing paint coating has deteriorated, and the bridge has become a visual blight.  The work is necessary for the preservation and upkeep of the structure and removing aesthetic blight, and is consistent with the City’s maintenance authority under the License Agreement.  City staff approached Lawndale to help coordinate the painting of the bridge.  Lawndale informed staff they did not have budget to contribute financially to this project, however, they are able to provide a no fee permit to the City’s contractor. 

 

The contractor will obtain a no fee permit for work within the City of Lawndale.  Metro has also confirmed that the City and its contractor are cleared to proceed and that no additional right-of-entry from Metro is required for the painting work. 

 

A City Council resolution is also recommended to confirm and document the City’s work on the bridge as “maintenance”, and allowing the City to take advantage of procurement methods available under Section 19.1(a) of the City Charter and Title 2, Chapter 6.1 of the Municipal Code. 

 

Staff prepared a limited Request for Proposal and distributed it to nine known qualified painting contractors.  Signature Painting Inc. provided the only response and was selected for recommendation after review of price, qualifications, bridge painting and lead-related experience, safety record, and favorable reference checks. 

 

The scope of work includes mobilization, traffic control, lead paint containment, hazardous waste handling and disposal, surface preparation, coating application, signage, and site restoration.  All construction activities will be performed during nighttime hours between 8:00 p.m. and 6:00 a.m., unless otherwise directed by the City Engineer, to mitigate traffic impacts.  While the term of the contract is for one year, the Contractor is expected to complete the work within 60 calendar days from the notice to proceed. 

 

The total not-to-exceed amount for the Agreement is $225,000, which includes $32,850 of contingency funding for unforeseen conditions such as damaged concrete, hidden steel repairs, or unexpected utility conflicts.  This amount conforms with the City’s Administrative Policy and Procedure 14.1 that sets policy for public works contract change orders.  Use of contingency funds requires prior written approval from the City Engineer and a written change order.  Staff recommends Council approve the maintenance Resolution as well as the agreement with Signature Painting Inc.

 

COORDINATION

The Public Works Department coordinated with the City Attorney’s Office, the City of Lawndale, and Metro to develop the proposed agreement and Resolution. 

 

FISCAL IMPACT

Funding for the maintenance work is available in the Capital Improvement Program Budget in the Artesia Rail Crossing Bridge Painting project account #41520.  The total not-to-exceed amount of the Agreement is $225,000, including $192,150 for project work as well as $32,850 in contingency funding.  No additional appropriation is required to complete the project.
