EXECUTIVE SUMMARY
On October 6, 2020, the City Council gave direction to bring back an ordinance to amend the municipal code to be able to waive the fees for preferential parking permits on a temporary basis if a neighborhood is located near a nuisance that is impacting parking.

BACKGROUND
To assist residents' issues regarding parking that is being impacted by a nuisance, Councilmember Gran proposed to amend the Municipal Code to waive the fees for preferential parking.
Title 3, Chapter 7, Article 17 sets forth the rules and regulations regarding preferential parking zones. On October 6, 2020 the City Council gave direction to amend the municipal code to allow for a fee waiver if a nuisance exists for up to one year. The proposed ordinance allows the City Manager or a designee to waive the preferential parking permit fees if a nuisance exists within 500 feet of the petitioning neighborhood. The City Manager or a designee would be able to make this determination based on resident complaints and the observations of the City Manager's employees such as code enforcement and police.
The proposed ordinance does not change the requirement for residents to sign a petition to show that at least two-thirds of the neighborhood are requesting preferential parking. In addition, the proposed ordinance would allow for an extension of the fee waiver for another year if City Council makes the same finding.
