EXECUTIVE SUMMARY

The City agreement with South Bay Center SPE, LLC for deployed personnel expenses will expire on June 30, 2021. As per the First Amendment to Services Reimbursement Agreement approved by City Council on July 1, 2019 the City “may extend this agreement for one additional year by providing South Bay Center written request to extend by the City Manager or designee and upon approval by the Mayor.” Per the agreement, the South Bay Center SPE, LLC will reimburse the City up to $306,666 annually for deployed personnel expenses for a total not to exceed $306,666. The City will provide $100,000 credit per year of support service (FY2021-22). This report serves to request that City Council approve a one-year extension of this service agreement with the South Bay Center SPE, LLC. 

 

BACKGROUND

In 2016 the Police Department, City Manager’s Office and the City Attorney’s Office worked with Forest City personnel to create a more effective security agreement that would better protect the two agencies and deliver the services when needed. The approved agreement shifted the management of the police officers from South Bay Galleria Management back to the Police Department's command staff. The modification to the service model has allowed the Police Department to better control the patrol operations and properly staff the South Bay Galleria during peak times when a uniformed presence is most needed. During the five years of operation this model has proven to work successfully for both agencies.

By working together with the Galleria Management and defining the best policing practices for the property, the Department has managed and controlled the service model of our police officers. The staffing of the mall is a critical component to the Department’s daily deployment of resources, and the current model allows the Department to ensure the staffing of the mall while not compromising the level of law enforcement services to the rest of the City. It is in the best interest of the Police Department, and the safety of the City, that the Department's command staff do everything possible given current resource levels, to staff the mall with officers under this current service model agreement. Operations were suspended during COVID-19 as Police Department deployments were adjusted to respond to the pandemic and with reduced traffic in the retail spaces. The Police Department has been in contact with South Bay Center SPE, LLC and operations are schedule to resume, under the existing contract, in June 2021 for the final weeks of the existing contract.

 

COORDINATION

The Police Department has coordinated with the City Manager’s Office.

 

FISCAL IMPACT

Per the agreement, the South Bay Center SPE, LLC will reimburse the City up to $306,666 annually for deployed personnel expenses for a total not to exceed $306,666. The City will provide $100,000 per year of support service. Funding for the City’s contribution is available in the Police Department’s annual operating budget. If the Council approves this extension, staff recommends that as part of the FY2021-2022 Budget motion Council includes the revenues of $206,666 in the Police Department budget as is outlined in the Budget Response Report.
