EXECUTIVE SUMMARY

On June 5, 2018, California voters approved Proposition 68, the “Parks and Water Bond Act of 2018” (Senate Bill 5). A number of grant programs for drought, water, parks, climate, coastal protection, and outdoor access will be supported with Proposition 68 bond proceeds.   One opportunity for funding is the “Per Capita Program” which provides $185 million to cities and counties statewide for local park rehabilitation, creation and improvements on a per capita basis. Under this program, grant recipients are encouraged to utilize awards to rehabilitate existing infrastructure and to address deficiencies in neighborhoods lacking access to the outdoors.

The process to obtain these funds is initiated by City Council adoption of a Resolution authorizing the City Manager to apply to the “Per Capita Program”.  Adoption of the Resolution expresses the City Council’s agreement with the State funding contract and confirmation the City will complete, operate and maintain the grant-funded projects. The Resolution also designates an authorized position, the City Manager, to represent the City and execute all documents and negotiations on behalf of the City.

After submission of the Resolution to the Office of Grants and Local Services (OGALS), the next step is to submit the application packet(s) by December 31, 2021. Once approved and executed per agreement, a completion packet of said project(s) must be sent to OGALS no later than March 31, 2024.

The City’s per capita allocation is $219,577 - composed of $177,952 in Office of Grants and Local Services funds and an addition $41,625 in Urban Counties category funds - and requires a 20% match to the cost of the project.  Staff recommends the City Council adopt the attached resolution and utilize the grant funds to install rubber surfacing at the Perry Park play area.

 

 

BACKGROUND

The Per Capita program originates from Proposition 68, placed on the ballot via Senate Bill 5 (DeLeon, Chapter 852, statutes of 2017), and approved by voters on June 5, 2018. Funds for the program were appropriated via State Budget item 3790-101-6088(b).  Grants are available for local park rehabilitation, creation, and improvement grants to local governments on a per capita basis. Grant recipients are encouraged to utilize awards to rehabilitate existing infrastructure and to address deficiencies in neighborhoods lacking access to the outdoors. 

Projects must be capital outlay for recreational purposes, either acquisition or development.  Projects not serving a “severely disadvantaged community” (median household income less than 60% of the statewide average) require a 20% match.  Grantees must use Per Capita grant funds to supplement existing expenditures, rather than replace them.  For example, a grantee has a budget for recreational capital expenditures of $500,000 per year, and is receiving a $200,000 allocation under the Per Capita program. The budget cannot be reduced to $300,000, with the Per Capita funds making up the difference. Similarly, if a project has been approved by the governing body, and a funding source has been identified, Per Capita funds cannot be swapped in as a new funding source unless the prior funding source is applied to other identified recreational capital projects.

Staff recommends the City Council utilize grant funds in the amount of $219,577 and appropriate $100,423 from the Quimby fee fund to install new rubber surfacing at the Perry Park play area.  The rubber surfacing at the play area has deteriorated and become inflexible.  The Public Works Department has had to repeatedly patch the resurfacing due to age, cracking, hardening and wear.  The project would also replace the current sand area with rubber surfacing.  The project supports the City’s Strategic Plan goal to maintain a high level of public safety with public engagement and assess, prioritize, and plan for reconstruction of major City facilities and infrastructure.  The project also meets the State’s criteria and would be eligible for grant funds as a development project.    

Staff estimates the total cost of the Perry Park project to be $320,000.  City Council allocated $220,000 for replacement of rubber surfacing at Anderson Park, Aviation Park, Perry Park, Andrews and Turtle Park as part of the 2021-22 Capital Improvement Program (CIP).  Staff recommends utilizing $100,423 In Quimby Funds to supplement the grant funding and to meet the State’s requirement of a 20% match ($64,000) for the cost of the project.  The City’s Quimby Fund balance for FY 2021-22 is $262,135.    

Estimates for rubber surfacing replacement for other play areas are as follows:

o                     Anderson Park   $499,720

o                     Aviation Park     $65,312

o                     Andrews Park    $65,312

o                     Turtle Park                           $52,000

The cost for Anderson Park is well beyond the grant funds allotted to the City from the State as well as the funding allocated in the CIP.  Staff recommendation is to incorporate funding for this project into the 2022-23 CIP.  Should the City Council move forward in allocating Quimby Funds for the Perry Park project, CIP funding would remain available to replace the rubber surfacing at Aviation Park, Andrews Park, and Turtle Park.

FISCAL IMPACT

The City’s per capita allocation is $219,577 and requires a 20% match of the cost of the project.  The cost estimate for the replacement of the rubber surfacing at Perry Park is $320,000.  The City Council has allocated $220,000 in the FY 2021-22 CIP for replacement of rubber surfacing at Anderson Park, Aviation Park, Perry Park, and Turtle Park.   Staff recommends the City Council utilize grant funds in the amount of $219,577 and appropriate $100,423 from the Quimby fee fund to replace the rubber surfacing at the Perry Park play area.  The City’s Quimby Fund balance for FY 2021-22 is $262,135.      Should the City Council move forward with the approving a grant application and allocating Quimby Funds for the Perry Park project, CIP funding would remain available to replace the rubber surfacing at Aviation Park, Andrews Park, and Turtle Park.
