EXECUTIVE SUMMARY

With the Governor’s Approval of AB 361, public agencies have been granted the continuing ability to conduct virtual meetings during declared public health emergencies under specified circumstances until January 1, 2024.  Based on the requirements of AB 361 (copy attached), in order for the City to conduct virtual meetings, the City Council needs to determine monthly that the following conditions exist: (1) There continues to be a health and safety risk due to COVID-19 being a proclaimed state of emergency with recommended measures to promote social distancing; and (2) Meeting in person during the proclaimed state of emergency would present imminent risks to the health and safety of attendees.

 

The other requirements associated with continued virtual meetings are outlined in the text of AB 361.

 

The recommended action is for the City Council to find that the following conditions exist and that they necessitate remote City Council and Commission meetings for the coming month:

 

1)                     There continues to be a health and safety risk due to COVID-19 being a proclaimed state of emergency with recommended measures to promote social distancing; and

2)                     Meeting in person during the proclaimed state of emergency would present imminent risks to the health and safely of attendees.

 

These findings will need to be made by the City Council  each month that the City opts to continue with remote meetings.

 

COORDINATION

All City Departments are aware of the requirements of AB 361.

 

FISCAL IMPACT

There is no additional fiscal impact associated with this action.
